Buying new construction in The Groves: what to know in 2026

Quick answer. As of October 2026 the builders we checked in The Groves report their communities sold out, so most buyers there are choosing among near-new resales or any remaining inventory. Whether new or near-new, bring your own agent, read the builder contract and warranty, get an independent inspection, and budget for the MUD 504 tax and HOA.

Is anyone still building in The Groves?

As of October 12, 2026, every builder community we checked in The Groves is marked sold out, with the most recent, Westin Homes, listed as sold out on April 28, 2026. That means “new” in The Groves today usually means a near-new resale or any remaining builder inventory. I check builder inventory directly before you visit.

Builder contracts and representation

TREC's New Home Contract (Incomplete Construction) is now TREC No. 23-20 (replaces 23-19); TREC lists its effective date as 07/01/2026, when its use became mandatory. Source

TREC 23-20 lets the buyer have the property 'inspected by inspectors selected by Buyer' (licensed or otherwise permitted), requires the seller to complete improvements per the Construction Documents, and says substantial completion may not extend beyond the Closing Date. It includes a notice referencing Chapter 27 of the Texas Property Code for construction-defect claims. Source

Both TREC new-home forms (24-20 completed and 23-20 incomplete construction, footer 05-04-2026) say 'Seller makes no other express warranties' and require the seller to 'assign to Buyer at closing all assignable manufacturer warranties'; any builder warranty comes from the builder's own documents. Source

On a new build, the builder’s sales staff work for the builder. TREC's Information About Brokerage Services (IABS 1-2, effective January 1, 2026) says a broker 'becomes the property owner's agent through an agreement with the owner, usually in a written listing,' must 'inform the owner of any material information ... including information disclosed to the agent by the buyer or buyer's agent,' and that an owner's agent's fees 'are not set by law and are fully negotiable.' Source Bring your own agent on your first visit; many builders require it to be registered then.

The Texas Residential Construction Commission 'was abolished and the Act expired on September 1, 2009'; the Legislature did not continue it (HB 2295 failed) and its records went to the Comptroller. Source Your protection comes from the builder’s written warranty, your contract and an independent inspection at each stage.
