Rules that shape what you can build
West University Place is its own city, so its zoning ordinance, permit desk, tree rules and boards apply to every home in it. Read these before you plan a remodel, a pool or a new home.
- Zoning ordinance (Appendix A) West University Place has a zoning ordinance, published as Appendix A of the city's Code of Ordinances on Municode. It sets zoning districts (single-family SF-1, SF-2, SF-3, townhouse, general residential, mixed use, commercial and planned development) and rules for building sites, permitted uses, yards and setbacks, open and pervious area, garages, building size and height, and parking. City of West University Place
- Zoning map The city publishes its zoning map through its GIS data hub, linked from the Zoning Ordinance page. City of West University Place
- When a building permit is required The city requires a permit before anyone builds, enlarges, alters, repairs, moves, removes, converts or demolishes a building or structure, and it specifically names fences and storage buildings. Permit types include building, plumbing, mechanical, electrical, stormwater and floodplain development. The permit desk is 713-662-5833. City of West University Place
- Standby generator permits Permanent generators need a building permit plus electrical (and usually plumbing/gas) permits, submitted by a licensed or registered contractor, with a survey showing location, setbacks, pad and elevation. Side-yard units must generally stay at least 3 feet from the property line in a sound-absorbing enclosure, and the city's noise limit is 70 dB at the property line (Code Sec. 54-40; zoning Table 7-6, Note 6). Portable generators using built-in receptacles do not need a permit. City of West University Place (Generator Requirements)
- Swimming pool permit conditions Under the city's pool permit conditions form, all code-required enclosure items (fencing, gates, latches, any required door alarms) must be installed and pass city inspection before water goes in the pool, and the tree disposition must be approved by the City Forester. City of West University Place
- New homes and additions: plan submission The city's plan submission requirements for new homes and additions call for framed area and open/pervious area calculations, a dimensioned site plan, drainage plans, a soils report and engineered foundation, and a completed tree disposition plan. Grade raising must be shown on the original plans or it needs an additional permit. City of West University Place (Plan Submission Requirements)
- Zoning Board of Adjustment The Zoning Board of Adjustment is a resident board that hears variance and special exception requests and appeals of zoning interpretations. It normally meets the fourth Thursday of each month at 6:30 p.m. at the Municipal Building, with no meetings in November or December. City of West University Place
- ZBA application requirements A ZBA request needs proof of ownership, a sealed survey, a narrative, photos and drawings, and a $1,000 filing fee per request, filed at least 20 days before a meeting. Owners within 200 feet are notified, and self-created or purely financial hardships do not qualify for a variance. City of West University Place
- Building and Standards Commission The city's Building and Standards body (listed as the Building and Standards Committee) hears appeals of the Building Official's non-zoning decisions, handles some nuisance enforcement and certain variances. It meets the first Thursday of each month at 6:00 p.m. City of West University Place
- Protected trees A permit is needed to remove any tree 12 inches or more in diameter anywhere in the city, or 10 inches or more in a front yard setback, a corner lot's side street setback or the right-of-way. During pre-development or construction, any tree of 10 inches or more on the site is protected. City of West University Place
- Tree removal permits and replacement Owners submit a tree removal application at Development Services (3826 Amherst); the removal contractor must be registered with the city and insured. Removed trees must be replaced (at least one 4-inch or 100-gallon tree per 10 replacement inches) or the owner can donate to the West University Tree Trust; dead, diseased or hazardous trees do not need replacement. City of West University Place
- Tree disposition plan Any development that could affect trees needs a tree disposition plan approved by the Urban Forester before a construction permit is issued. It includes a tree survey with critical root zones (including neighboring trees), the site plan and utility lines, and a protection narrative with 6-foot chain link fencing around root zones. The city lists fees of $250 for large construction and pools and $150 for short-term projects such as remodels and demolition. City of West University Place
- Urban forest ordinance (Chapter 82) Tree rules are in Chapter 82, Urban Forest Preservation and Enhancement, of the city code. New-home plans must show at least one qualified tree in the front yard, and removing or damaging a large tree without an approved disposition plan is prohibited. City of West University Place
- Floodplain development and elevation rule All development in the floodplain, including new construction, filling, grading and paving, needs a permit under Chapter 18 of the city code. The city requires new and substantially improved buildings (50% of market value) to be built at least two feet above the base flood elevation, including equipment such as air conditioning units. City of West University Place
We did not publish exact setback, height or lot-coverage numbers because we could not confirm them in the current code. Ask the city before you plan an addition.
