How Michael helps
Finding property inside your deadlines
- Set criteria early. Price range, property type, areas, financing and how much management you want, ideally before your sale closes.
- Build a shortlist. Public listings, privately marketed property and portfolios that fit, each clearly labeled.
- Evaluate each one. Verified rent, expenses, condition and the questions to take to your advisers.
- Negotiate and close. Contract timing that respects your identification and exchange periods.
The rules to plan around
- Replacement property must be identified in writing within 45 days after you transfer the property you give up.
- It must be received within 180 days, or by the due date of your tax return (including extensions), whichever is earlier.
- Since 2018, Section 1031 applies only to real property held for business or investment use.
- Cash or other non-like-kind property you receive can be taxable.

What property qualifies for a 1031 exchange now?
Since the Tax Cuts and Jobs Act, Section 1031 applies only to real property held for productive use in a trade or business or for investment, not to personal or intangible property. Real property held primarily for sale does not qualify. Your tax adviser decides whether a specific purchase fits your exchange.

What is Michael's role in a 1031 exchange?
Michael is a real estate broker. He helps you define criteria, find and evaluate Houston-area properties, and negotiate the purchase on your timeline. He is not a qualified intermediary, CPA or attorney and does not give tax or legal advice; those advisers structure and document the exchange.
Can the rental portfolio be used as 1031 replacement property?
Possibly, but no property qualifies for every exchange and none comes with guaranteed tax treatment. Whether a purchase fits your exchange depends on your relinquished property, your timing and your adviser's review.
